These Terms of Use (“Terms”) govern your access to and use of the ShoreVibesByMaria.com website, and any purchase you make through it (together, the “Site”). By visiting the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to use the Site or place an order. By using the Site, you represent that you meet this requirement.

2. Products, Pricing & Availability

We make every effort to display our apparel and beach/lifestyle products, descriptions, and pricing accurately. However:

  • Colors, textures, and details may vary slightly from what is shown on your screen due to device display settings.
  • Prices, promotions, and product availability are subject to change without notice.
  • In the event of a pricing or listing error, we reserve the right to cancel the order, notify you, and issue a full refund.
  • We reserve the right to limit the quantity of any item purchased per person, household, or order.

3. Orders & Payment

Placing an order through the Site is an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or unavailable inventory). Your order is not final until you receive a shipping confirmation.

Payment is processed securely at checkout through our third-party payment processor. By submitting payment information, you represent that you are authorized to use the payment method provided. You are responsible for any applicable sales tax, which will be calculated and added at checkout where required.

4. Shipping

We will make reasonable efforts to ship orders promptly, but shipping times are estimates and not guaranteed. Risk of loss and title for items purchased pass to you upon our delivery to the shipping carrier. Shore Vibes by Maria is not responsible for delays, loss, or damage caused by the shipping carrier once an order has left our hands, though we're happy to help you file a claim with the carrier.

5. Returns & Exchanges

We want you to love your Shore Vibes gear. If something isn't right, you may return eligible items within 14days of delivery for a refund or exchange, subject to the following conditions:

  • Items must be unworn, unwashed, and in original condition, with all original tags attached.
  • Items must be returned in their original packaging where possible.
  • Proof of purchase (order confirmation or receipt) is required.
  • For hygiene reasons, swimwear must have the protective liner tag intact and unremoved to be eligible for return.
  • Final sale, clearance, and gift card items are not eligible for return or exchange.

To start a return, contact us using the information below. Refunds will be issued to your original payment method within 3 business days of our receiving and inspecting the returned item. Return shipping costs are the responsibility of the customer unless the item arrived defective or incorrect, in which case we will cover return shipping.

6. Account Registration

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us immediately of any unauthorized use of your account.

7. Intellectual Property

All content on the Site — including text, graphics, logos, product photography, and design — is owned by or licensed to Shore Vibes by Maria and is protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission.

8. User-Generated Content

If you submit a product review, photo, or other content to us (for example, through social media or a review form), you grant Shore Vibes by Maria a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with marketing and promoting our products. You confirm that any content you submit is your own and does not infringe on the rights of any third party.

9. Prohibited Conduct

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, its systems, or other users' accounts
  • Interfere with or disrupt the operation of the Site or its servers
  • Submit false, fraudulent, or misleading information, including for orders or payment
  • Use any automated system (bots, scrapers) to access the Site without our permission

10. Third-Party Links

The Site may contain links to third-party websites (such as social media platforms) that are not owned or controlled by Shore Vibes by Maria. We are not responsible for the content, privacy policies, or practices of any third-party sites.

11. Disclaimer of Warranties

The Site and all products are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Shore Vibes by Maria shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of our products. Our total liability for any claim arising from your order shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Shore Vibes by Maria, its owners, and representatives from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts. Before filing a claim, we encourage you to contact us directly so we can try to resolve the issue informally.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. The “Effective Date” at the top of this page indicates when these Terms were last revised. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shore Vibes by Maria regarding your use of the Site and supersede any prior agreements.
